This Liability Waiver applies to all products manufactured or supplied by
BOS Oceansport Pty Ltd.
1. Assumption of Risk
You acknowledge that paddling, surf ski use, and ocean activities involve inherent risks, including but not limited to:
- injury, drowning, or death
- collision with objects or other water users
- unpredictable weather and water conditions
- equipment failure due to misuse or environmental factors
You voluntarily assume all risks associated with the use of our products.
2. Safety Obligations
You agree to:
- use BOS Oceansport products only as intended
- follow all safety instructions and guidelines
- wear appropriate safety equipment (including PFDs and leashes)
- assess weather and water conditions before paddling
- ensure you have adequate skill, fitness, and experience
- comply with all local maritime laws and regulations
3. Release of Liability
To the fullest extent permitted by law, you release and discharge BOS Oceansport Pty Ltd from all liability for:
- personal injury or death
- property damage
- economic loss
- consequential or incidental damages
arising from your use of our products, except where liability cannot be excluded under the ACL.
4. Indemnity
You indemnify us against all claims, losses, damages, and expenses arising from:
- your use or misuse of our products
- your breach of safety obligations
- your negligent or unlawful conduct
This indemnity survives termination of this Waiver.
5. Fitness to Participate
You warrant that:
- you are physically capable of participating in paddling activities
- you have no medical conditions that would make participation unsafe
- you will not use our products under the influence of alcohol or drugs
6. Australian Consumer Law
Nothing in this Waiver excludes, restricts, or modifies any consumer guarantee under the ACL.
